Kenyan visa/citizenship problem

Hi! I will try to make this as simple as possible..

My dad is Kenyan and my mom is from a European country, I've been leaving in Europe all my life.
But now iv been starting to come to Kenya more often, this time i was planing to stay for one month and then go back. So at the airport they were kind and gave us a visa for 2 months just in case..

Anyway, we wanted to stay longer so now we have been here for almost 4 months.

I wasnt really thinking about the visa thing at all, because people was telling me that since the constitution past i have nothing to worry about, because my dad is Kenyan so now i can have two citizenchips. And plus i was on my way to get my Kenyan ID.

I got into some issues with my dad so i think he wants me to go back to Europe for awhile.

Because recently he is starting to act funny. He is telling me that the guy(my dads friend)who helped me with my ID cant release it(i told him to give it to my dad when it came) because he dont want to get into trouble because our visa expired.(and he is saying "if you had your ID this wouldnt be a problem") Now he is telling me its a BIG thing, before he was the one who told me its not and its easy for me to get the id, but suddenly its a problem.

I went to talk to a guy who works in a travel agency and he told me that it shouldnt be a problem because of the new constitution , but not to go to the emigration center(??) because Kenya is still corrupt and they can charge me anyways.

So all this is confusing me! Everyone is telling me diffrent things.. and because im not used to Kenya i dont know who i can talk to.

Thats the short story, hope you understand and can help me.

Whats really right?? Have i right to stay in the country?? I need my ID, who can i talk to about it??

My husband is a senior guy at the immigration and he's told me that what you should do is to go to the nearest immigration office preferably nyayo house in Nairobi, curry with you your dad's documents proving he's a Kenyan like his birth certificate and maybe yours however your passport will indicate that. If you show that proof all they will have to do is stamp your passport to indicate that you are also a Kenyan.

To tell you the truth, the procedure of issuance of the twin citizenship has not explained to the civil servants and therefore they may be as confused and fearful when issuing you with an ID.

So your father may not be entirely wrong because the issuing guy may have developed 'cold feet' based on lack of procedure.

But if you explain to the immigration that your dad is Kenyan and that you will be staying in for several months, they will not have problems giving you a visa for even one year. Just be sure to carry your dad's ID when making the next visa application.

The constitution passed allowing dual citizenship. However its implementation might take up to 3 years. Parliament has to create laws governing various sections of the constitution. The clause on dual citizenship should be implemented this year. Then you can apply without having to solicit or bribe anyone since there will be a set time based rules and regulations governing all this.

As for you dads friend, he probably saw an opportunity to make money. If you were not born in Kenya, and you are already a citizen of another country... you can't get a Kenyan ID.... until the issues of dual citizenship is dealt with. However if you were not a citizen or another country or you denounce you current status, then it would be easier. I suggest you be patient until the laws and guidelines are in place.
