Buying a plot of land in Mwabungo, Ukunda, Kenya

I live in England and my boy friend is Kenyan and lives there. I have know him for 16 months and visited Kenya quite a few times. He is wanting to buy a plot of land for both of us. We intend to buy the land and build to rent out and also build a cottage to live in.

I am in England at the moment and he is saying we can do this in stages i.e put the deposit down and pay as I can afford it as I will be funding all this.

He has seen the plot of land for 250,000kes & requires the deposit of whatever I can send him. I am dubious of this as I would require this land in my name as well and I am unsure how to go about it. I dont send any money yet as I need to know this is all legal and not just for him and I think he buys the land cheap cause it is near the village where he lives. I really want to know if this is possible for me to do or should I stay well away from this idea.

Follow the Following Steps NEW

Step 1: Dont be in a hurry. Find time and come to Kenya. Get an Official search at the Kwale Land Legistry.

Step 2: For safety of your investment, let there be an official notification to the District Land Board to authorise the sale of the Land.

Step 3: The land Board will verify from the area chief, Village eleders and the family of the seller wether there is any one who has a legal claim, either being a son, a wife ,brother, a mother or a father of the seller as to wether there any one of them who has claims on the land.

Step 4: To be extra safe, you may put an advert in the Kenya Gazzet which is the only official goverment paper. The advert should carry your written expression and intent to purchase that land indicating its location and status. This guards you incase in future, someones comes to lay claim over it or the goverment says that was land allocated for public utility. The notice helps to idemnify you from accusation of negligence hence making you legal right even in future

Step 5 : Let Land Surveyors visit the plot and errect official beackons

Step6: Let there be an official land agreement and a discharge document detailing the nature of the sell and purchase and purpose of land use

Step7: Process land transfer, making the title bear your name.

Step 8: Proceed with your construction

Step 9: It is a worthy idea. I come from South Coast but am currently in New York. Any advise required iam willing to give freely becuase any investments there will be a great benefit

I am kenyan and reside in the USA. I have bought plots and continue to buy. Listen, get a lawwyer in one of your visits and work out the paper work required. You can buy in instalments but only through lawyers representing all the parties involved where you both agree on instalments, the seller leaves the title to the land with the lawyers. Also before buying make sure you do a title search. Bottom line, you better of paying in full andgetting your title to the land. After that, build rental and your own vacation house. while there, you dont have to pay for a hotel and when you gone, rent the house or let your boy friend use it. Hey, you stand to gain by investing. Just do your research well before diving into a deal (use a lawyer).

At the moment you would not be able to buy any "agricultural" land in your own name As Kenyan law prohibits this Also there is no purchase on instalments as once you give the money it will be gone and the price could increase whenever the seller wished so it would be a bottomless barrel. I am married to a Kenyan(Ukunda) and until the new constituition is in force cannot do so either tHE LAND REGISTRY IS NOW BEING REVAMPED AND "SIMPLIFIED* as you can get title deeds but find it is challenged by another member of the sellers familly with you being the loser. As well as this there is a funny little quirk that you agree the price for the land, sign the document and then get told you only bought the land and get demands for the value of any trees etc. on the property. Your boyfriend would be in sole ownership and if you break up in a male orientated world like Kenya, he gets the lot.

Finally remember if you do go ahead, not all solicitors are honest and many can disappear and the seller is responsible for ALL legal costs.
Need any help with local; contacts police, safe solicitors or agents.

Don't buy anything unless you are seated with a genuine lawyer to sign documents of a land that has certified, not to belong to twenty different people with different title deeds. I can't help you much but I also have a land in ukunda and live in the US. Many even boyfriends can be conmen.

hi Eva you sound as if you do not know your boyfriend so well. How do you expect this people to give you the right advise? Do what you think is right do not spill the beans. We are not interested in what you and your boyfriend intent to do, in anycase this people will just discourage you and you will do nothing. Look! Some of them have already concluded that you are an old lady who wants to take advantage of the poor digo boy.

i feel sorry for the young men

Men normally go for the young girls because their wives have began old and can no longer meet their daily demands. As you already know men can remain active as long as they are alive. But women loose the steam at just 50 yrs. Now this young man telling us that we have taken their girls does not understand the siuation he is in. Ok, just go for the old lady for material gain and not for love or happiness for matter. You cannot leave a new car and go for an old junk unless your brain needs some inspection .we marry women and not another way round.

Yes, I understand entirely your concerns. Your comment is quite personal to each individual and their particular circumstances. There are many older men with young women and vice versa; not just in Kenya or my community but all over the world and if it brings happiness to those concerned, why not?
Morally, ethically who can say if it’s right or wrong; there are many crimes far worse in this life than finding happiness.

We have decided to go for our grandmothers because all the young girls have been taken away by our old grandfathers. So please mr. Ego stop the oldmen and we shall stop from marying old women. We do not care about age after all these women are human being and they are rich unlike our girls who poor, cheap and money maniacs. Just have them we do not care. We're okay with our grandmas.

Dear Eva, they say too much of something is poison, you have had alot of comments from different people all over the world, so by now I thing its up to you to weigh and make your own decision. Please I would also like you to give me your answer on this subject!as I told you, I come from Eldoret in western part of kenya. When I came here, I found many old ladies going about with young men as young as 20yrs. Is it morally upright in the white community for old women to make friends and make love to young men? it depends on how your friendship is you know him better no individual can help you except every one is an opportunist and would want to make contact with you so that you can spoil your friendship Government is there to assist you but most people are jealous it does not matter whether he is a lawyer or works with NGO or what.

Personally speaking, I believe that enough good advice has been given to this lady.
If she chooses to ignore what a number of knowledgeable people have said, then it is up to her. She will have to make up her own mind as to what is the best course to take and accept the consequences.

If I were you lady, I would not part with a dime without a real lawyer, and mind you there are a lot of fake ones there too. All I would advice is that you be careful - you might end up with an empty account, broken heart and Eva who question mark.

Your concerns are real. I was born in Mwabungo, my parents still live there and I also have property - a house and a farm (planted with commercial casuarinas trees) near Galu Primary school.

Currently I live in Addis Ababa Ethiopia where I work for an international NGO. I frequently visit home (Mwabungo) and the last time I was there was this month (September 10). I will return in mid December. I am very to assist you in this.

I know most of the boys in the village. Kindly write given me details (full name and parents' name) using the email address below and I will advice you whether he is a honest person or not. I will also find out if he has genuinely found land for the project or it is a ploy. I would hate anybody to be conned his money. Some of the boys are tricksters.

I think that Mohamed is right about this. I felt that at some time it needed to be pointed out that there are many instances of young and older women being persuaded to part with large sums of money, only to end up losing everything and suffering a broken heart. Of course it doesn't just happen in Kenya, but it sure seems to be a not infrequent occurrence on the Kenya Coast.

Both of you are still young and easily get excited. My advice to you dear lady is to be extra careful with these boys, most of them are very poor and have never seen more money. So you give him money and you will regret the rest of your life. Why not look for a Kenyan gentleman who has gone to university who can relate and tackle issues in a sober manner. If you continue with boy you will shame your parents and us Kenyans.

i think this is a very reasonable price for a plo in mwabungo.its price for a kenyan.if you buy yourself it will be atleast 4 times expensive.just get a lawyer so that your name appears on the title and i think its no bad deal.Im buying myself a smaller plot at ukunda for 400000ksh 1/8 acre.

Thank you so much for your advice. I think you may be right, buy one already built and up for sale. It certainly sounds to be a minfield buying land out there, and I certainly wont be parting wih any money at the moment!

Thankyou for your question and Chris has covered it very well.

My suggestion to you would be get your bottom out there and take time by yourself to assess the area and delve into the complex land ownership details of owning land in Kenya. I would further suggest that you find yourself an independent lawyer to help you out bearing in mind that this may be hard to do.

Do not part with any money meantime. Please do not do that until you have been there and know what is yours by deed or title.

I understand its hard with having a boyfriend who is guiding you but I want to give you the advice from this website and myself. I am sure all the other moderators would say the same.....keep your money in the bank, keep your senses, keep asking questions and keep us informed.

Buying Land on the Coast

Hello Eva;
This is a very contentious issue and before you even part with a pound or euro or Ksh, you need to find out all you can about the land you are planning to buy. Where is the land, How much of it is up for sale, Does it have a Government lease on it. Is there access to it from the road. Who claims to own it, Who has the title to it, Does more than one person own a share of the land.
If you are sure you know that the person who says they own the land in fact does, then visit a local estate agent in the Ukunda Area if there is one. Pay nothing to anyone at this stage.
Ask the agent what the going price for land is in Ukunda and see what land they have for sale.

You raised issues about corruption in another comment and sadly at every turn you should be aware that the problem could arise in your quest to buy land and build on it.

If you are satisfied the price is fair, then still speak to someone who understands real estate sales and purchase legalities. Knight Frank Estate Agents in Mombasa or Nairobi for example,I think have a department that deals with this. Talk to Knight Frank Overseas in the UK and really get to understand what is entailed.
The next hurdle is to do with building on the land, the permits, the cost of getting water, sewage, and electricity to the site and sorting out all the local regulations as to what you may or maybe not allowed to do.
Maybe it would be better for you to look for a property up for sale and buy it that way if it is within your budget.
You will have noticed that I haven't mentioned 'Lawyers' yet. That can be an even bigger minefield. I could go on.....
